Partner Daniel Shapiro and Associate Aharon Kaye of the firm’s Litigation and Dispute Resolution Practice authored an article for The Secured Lender on the subject of lender liability in the wake of the financial meltdown. They write, “The courts have considered the role that lenders play in our economy and, for the most part, have declined to force lenders into the role of a superregulatory agency tasked with reporting on or exercising control over the conduct of their borrowers.” The authors cite several recent cases in which courts have ruled that lenders are not liable for the actions of their borrowers.
