The advisory explores how to reduce the risk that prepetition lease payments will be clawed back from an aircraft lessor in a US bankruptcy of the lessee. Drawing on information from a recent US bankruptcy case, King v. Bombardier Aerospace Corporation et al., Timothy describes the arguments by the bankruptcy trustee and the lessor and the court's ruling and offer suggestions for structuring and practice for aircraft leases to mitigate the clawback risk.
