Katten continues to help providers navigate federal, state and local laws as they look to restart elective surgeries and procedures. Providers are forced to take legal, licensure, operational and payment risks as they look to provide care to patients that are languishing at home with debilitating conditions that are not critical. Many of the reopening requirements are based on representations that the providers' services will not reduce the available personal protective equipment (PPE) needed to respond to the COVID-19 crisis despite the fact that PPE is necessary to ensure the safety of the physicians, nurses and other staff.
