Katten Partner and National Chair of the Private Wealth Department Joshua Rubenstein was quoted in an International Bar Association (IBA) article examining the Trump administration's mass deportation agenda and its far-reaching consequences for families, children and the rule of law. In his capacity as Chair of the IBA Family Law Committee, Josh addressed the lasting harm that the administration's deportation policies are inflicting on families and the challenges posed by institutional checks on executive power.
Josh commented on the limits of the legal system in curbing the administration's most controversial immigration actions, noting, "Trump has a very successful strategy of doing whatever he wants and seeing if the system stops him." Because courts operate on a case-by-case basis, he observed, "a lot gets through because you can't stop everything." Looking ahead, Josh expressed confidence that the judiciary would ultimately impose limits: "The system will challenge him one important case at a time. But in the meantime, look at all the damage he's caused."
