Katten Chairman Gil Soffer will co-present during the Enforcement Priorities session at the 2026 Corporate Enforcement Forum on Thursday, May 14, starting at 9:40 a.m. CT. Curated by Cambridge Forums, the Corporate Enforcement Forum is an exclusive, invitation-only convening of distinguished trial lawyers and senior in-house counsel from across the United States, focused on the representation of corporations and individuals facing white-collar crime issues.

Drawing on his experience in complex government investigations and his tenure as Associate Deputy Attorney General at the Department of Justice, Gil will discuss the Trump administration’s stated enforcement priorities and its pullback from longstanding initiatives, most notably FCPA enforcement. The presentation will also explore how widespread staffing reductions across enforcement agencies are affecting investigations and prosecutorial decision-making. This session will address the new enforcement landscape, including the following topics:

  • “Transnational criminal organizations” (TCOs). What does this mean, and how broadly is it applied?
  • Cooperation and self-disclosure. Recent guidance continues to emphasize the importance of cooperation and self-disclosure. What are the risks of self-disclosure in the current environment, and has the calculus changed?
  • DOJ guidance emphasizes “efficiency.” The DOJ is streamlining investigations, reducing the use of corporate monitors, and more. What does this mean in practice, and does it affect defense strategies in government investigations?
  • False Claims Act investigations. To what extent have these been pursued with respect to gender-affirming care, DEI and other areas targeted by the Administration?
  • Trump administration’s stated priorities. How does this compare to reality? And what has been the effect of the exodus of government personnel (forced and voluntary) on investigations and prosecutions?
