Three Katten attorneys will participate in the IPMI's Healthcare Law & Compliance Institute on February 23–25. At 12:30 p.m. on Sunday, February 23, Health Care Partner Laura Keidan Martin will speak on the "Critical Insights, Updates, and Considerations in the Healthcare Law Landscape" session, discussing the large-scale change in the health care industry over the past decade as hospitals and health systems have had to evolve in an increasingly complex environment to sustain themselves. With the disruptive forces over the past several years threatening to dramatically transform health care as we know it today, and the massive disruption caused by the COVID-19 pandemic, health care leaders need to stay abreast of critical developments within the industry. In this unique session, attendants will have the opportunity to hear from a diverse group of lawyers who are well versed in the issues impacting health care providers today. Whether mergers, acquisitions and dispositions, joint ventures and syndications, contracting, regulatory and operational matters or compliance and investigations, the panel has seen it all, heard it all and dealt with numerous situations from which they will draw upon to answer some of the key questions on the minds of hospital and health system GCs and CLOs.
At 2:30 p.m. on Sunday, Laura, as well as Health Care Partner Ramana Rameswaran and Counsel Tracie Bedeaux, will present the "Best Practices for Health System Innovation Centers" Think Tank session, sharing strategies and ideas around working with their innovation centers, including in relation to:
- Structural issues (e.g., pros and cons of a separate entity vs. keeping an innovations center in-house in relation to intellectual property, HR, legal and more)
- Incentivizing faculty and staff innovation and participation
- Addressing conflicts of interest
- Advantages and pitfalls of working with third-party partners
At 4:15 p.m. on Monday, February 24, Tracie, Laura and Ramana will present the "Innovative Physician Partnerships" session, showcasing health system innovations in physician partnerships that facilitate alignment and growth while preserving physician independence, including:
- Real world value-based models that comport with the Stark Law VBA exceptions
- Service line and ancillary service collaborations
- Physician group practice joint ventures
- Synthetic employment/PSA models
- Technology, data and IP ventures
The discussion will also cover the regulatory pitfalls and how to structure these arrangements to minimize fraud & abuse risk.
