Two Katten Health Care attorneys will present on Tuesday, October 12 at this year's virtual Texas Health Law Conference. Partner Kenya Woodruff also will participate in her role as member and Secretary of the Texas Health Law Section Council.

Missy Apodaca, senior counsel, will co-represent the "Keeping Up With Surprise Billing and Price Transparency — the Impact on Health Plans, Provider and Patients" panel at 9:30 a.m. CT. The panelists will provide an overview of the new laws and regulations, potential reimbursement levels under the No Surprise Act's requirements, ways health plans and providers can use their own data to be better prepared for "baseball-style" arbitration, and how payers and providers can leverage the transparency data better to inform their contract negotiation process and their out-of-network reimbursement strategies.

Laura Keidan Martin, partner, will co-present the "Health Care Antitrust in the Brave New World" breakout session at 10:30 a.m. CT. The presenters will share insights and practice pointers into several emerging health care antitrust hot topics. They will cover health care competition initiatives announced in the July 2021 Biden Executive Order, including:

  • limiting or banning the use of non-competes;
  • DOJ’s continued emphasis on deterring the use of so-called "no-poaching" agreements by invoking criminal process;
  • recent and planned merger policy and rule changes; and
  • the current state of the implementation of hospital price transparency laws at the federal level.
