Intellectual Property and Privacy, Data and Cybersecurity Associate Anita Hodea was quoted in the media, including by Tech Informed, City AM and The Legal Diary, regarding the EU Data Act (Act), which came into force on September 12. The Act sets a new benchmark for how data is accessed, shared and governed in Europe's digital economy.

"The Act aims to create a fairer and more competitive data ecosystem, applying to manufacturers and service providers of connected products, providers of related digital services, and cloud and edge service providers," Anita said, adding that the Act "encompasses all data processing activities, covering both personal and non-personal data."

"Where personal data is involved, the [General Data Protection Regulation] takes precedence, ensuring privacy and protection remain intact," Anita explained, adding that "the introduction of new terms, such as 'data holder', and limited guidance on their application mean organisations must carefully define roles, governance and responsibilities to comply with both frameworks." For companies, Anita stated that the Act "requires designing products for accessible and secure data, enabling fair third-party sharing and improving transparency," and commented that these changes "promise more open markets, stronger innovation, and empowered users across the [European Union]."
