Michael Callahan, of counsel on Katten's Health Care team, will present "Defending Against Patient Safety Act Discovery Requests – Case Law Development and Lessons Learned" webinar on Thursday, December 5 at 1:00 p.m. Central. Michael will review recent court decisions that have interpreted the scope of privilege protections afforded under the Patient Safety and Quality Improvement Act of 2005 (PSA). The presentation will include a discussion of the recent decision of a Pennsylvania federal court in Rumsey v. Guthrie Medical Group — a medical malpractice suit in which the court held that incident reports and discussions relating to an adverse patient event were protected deliberations and analysis. This is the first reported case in which a court relied on this pathway versus the reporting pathway for creating PSWP. The presentations topics which will be covered include:

  • a summary of recent key PSA court decisions;
  • recommended steps to take in order to maximize state and PSA privilege protections; and
  • litigation lessons learned and impact on existing PSES policies and operations.
