- provide an overview of the Medical Studies Act and its amendments as well as the evolving case law interpretation of the privilege protections.
- provide a summary of the Grossheusch and Nielson decisions, the court's holdings and the impact on hospital and medical staff peer review and quality assurance procedures.
- identify proposed modifications to hospital procedures to limit the adverse impact of these two decisions if followed by trial courts and in order to maximize the privilege protections.
- recommend litigation steps to take to defend against discovery subpoenas and motions to compel.
