Jason discussed how attorneys can help sports teams protect commercial interests as they work with municipalities to transform areas surrounding stadiums into commercial and entertainment hubs. "Because these are not independent parcels that happen to work together," Jason said. "You do need a coordinated regime in order to ensure this curated fan experience, as well as to protect the intellectual property."
He also addressed the importance of managing public disclosures and maintaining flexibility in ownership structures for sports district projects. Jason explained that teams and developers involved in public-private projects should be mindful of what information may become public under state and local open records laws, particularly where confidentiality and public perception are important considerations. "A big part of it is really guiding the clients through awareness of what they are revealing, if you will, to the extent they may not want to and do not have a need to when dealing with a public entity," Jason said.
