'Smart, sophisticated' lawyer, counselor and negotiator at the trial and appellate levels

As approachable as he is dogged, clients describe Eliot as a "smart, sophisticated lawyer" with "extremely good judgment." His experience spans trial and appellate courts, where he has tried civil and criminal cases involving mail and wire fraud; tax fraud; false statements to state and federal agencies; commodities fraud; transactions in government securities and commodity futures; market manipulation, accountants' and other professionals' liability; false advertising; contract and agency disputes involving real estate; product liability; and other commercial transactions.

Clients also call on Eliot to handle proceedings conducted by the Department of Justice (DOJ), the Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), state attorneys general, state accountancy boards and other agencies. He is well-versed in litigation relating to bankruptcy proceedings and in matters before the Commodity Futures Trading Commission (CFTC) and the Environmental Protection Agency (EPA).

Eliot routinely serves as counsel to special board committees, including audit committees, and in connection with independent investigations of internal corporate affairs. Specifically, he routinely evaluates and defends fraud, negligence and statutory claims, including in class actions, against corporate issuers, directors and accountants in matters relating to audits and presentation of financial statements and related corporate disclosures.

For many years, Eliot was an active member of the arbitration panels of the American Arbitration Association (AAA) and several industry bodies. He also has represented clients in commercial arbitrations and mediations in the United States and abroad.
