As panel counsel for AIG on their Technology/Media Panel, Katten attorneys secured dismissal of a case filed by a party against YCharts, an AIG-insured company, in a California district court. In the case, Katten's client received financial data from a reputable company, but the data was incorrect. An investor relying on the data experienced financial losses as a result. However, the terms of use he agreed to disclaimed any liability based on the inaccurate data. The court denied a request to amend the complaint as the defects cannot be cured.
Floyd Mandell, national co-chair of Katten's Intellectual Property group and co-head of the Trademarks and Trademark Litigation practice, led the team, which included Intellectual Property special counsel Carolyn Passen and associate Eugene Endress.
